Guidelines for law enforcement

Care.com provides these guidelines as a resource to law enforcement authorities seeking information about Care.com accounts. Additional information is available in our Privacy Policy and Terms of Use.

What is Care.com?

We are an online marketplace with a goal of helping families and caregivers connect in a reliable and easy way. In general, we do not employ any of the caregivers who appear on our site, nor do we function as an employment agency.

What account information does Care.com have?

A Care.com profile may contain a variety of information that families and caregivers provide about themselves. For instance, it may include a family’s job postings describing their care needs or a caregiver’s background and experience. Profiles may also include a member-provided profile picture or reviews from other members. Care.com also has certain non-public account information, which may include a member’s email address or phone number.

How does Care.com retain user data?

Care.com retains different types of information for different time periods, in accordance with our Privacy Policy and Terms of Use. Some information we store is automatically collected while other information is provided by the user. Some of this data (e.g., IP logs) can change each time a member accesses the site and may only be stored for a very brief period of time.

We cannot guarantee the accuracy of any of the information we store. For example, a user may have created an account or profile using false information or may use certain techniques or technologies to mask or alter their online activity.

Please note that once an account is closed or deactivated (whether by Care.com or by a member), we may not be able to access certain account information. Also, we are generally unable to access content that a user has deleted, and we may be unable to access content or account information that a member has changed.

Requests for Care.com account information

Requests for member account information from law enforcement should be directed to Care.com, Inc., Attn: Legal Department, 816 Congress St., Suite 800, Austin, TX 78701, USA. Care.com has a strong interest in maintaining the safety of its community, and it responds to valid legal process issued in compliance with applicable laws, including but not limited to the federal Electronic Communication Privacy Act, 18 U.S.C. § 2702 and 2703.

Care.com also accepts requests from law enforcement to preserve account records that are potentially relevant to legal proceedings. Upon receipt of a valid request, we will preserve, but not disclose, a temporary copy of relevant account records for up to 90 days pending the service of valid legal process. Such requests should be issued on formal law enforcement letterhead and be signed by the requesting official.

Non-public information requires a subpoena or court order

Care.com can only release non-public information about its members (excluding private member messages) to law enforcement in response to appropriate legal process such as a subpoena, or court order, or in response to a valid emergency disclosure request. Please note that Care.com can only disclose basic subscriber information in response to a subpoena.

Contents of communications require a search warrant

In accordance with federal law, Care.com can only release the contents of private member-to-member communications upon receipt of a valid search warrant from a court with proper jurisdiction over Care.com.

Productions of records

Unless otherwise agreed upon, we currently provide responsive records in electronic format.

Cost reimbursement

Care.com may seek reimbursement for costs associated with information produced pursuant to legal process and as permitted by law (e.g. under 18 U.S.C. §2706).

Emergency disclosure requests

In line with our Privacy Policy, we may disclose account information to law enforcement in response to a valid emergency disclosure request.

Care.com evaluates emergency disclosure requests on a case-by-case basis in compliance with relevant law (e.g., 18 U.S.C. § 2702(b)(8) .) If we receive information that provides us with a good faith belief that there is an exigent emergency involving the danger of death or serious physical injury to a person, we may provide information necessary to prevent that harm, if we have it.
